Platform Ownership, Intellectual Property, Cultural Heritage & Tribal Rights Notice
Hadjo Tribal Education™ | Hadjo Education™ | Hadjo Education System™
© 2026 Red Stick Communications & Media. All rights reserved in original materials owned by Red Stick Communications & Media.
1. Platform Ownership and Proprietary Rights
The Hadjo Tribal Education platform, including the Hadjo Education System, is developed, operated, and administered by Red Stick Communications & Media, an enterprise identified with the Yamassee Indian Tribe of Seminoles, also known as the Yamassee Indian Tribe or Yamassee Nation.
Subject to applicable ownership agreements, licenses, and third-party rights, Red Stick Communications & Media claims all applicable intellectual-property and proprietary rights in its original software, source code, platform architecture, user-interface designs, educational content, lesson materials, original illustrations, graphics, animations, audiovisual materials, databases, distinctive content arrangements, branding, and related proprietary developments.
No provision of this notice grants any person an ownership interest in the platform or its protected intellectual property.
All intellectual-property rights not expressly granted are reserved by their respective lawful owners.
2. Tribal Identity, Historical Continuity and Reservation of Rights
The Yamassee Indian Tribe of Seminoles, also known as the Yamassee Indian Tribe or Yamassee Nation, asserts its continuing Indigenous identity, historical community, ancestral relationships, cultural heritage, and inherent rights as a Native American tribal nation.
The Tribe identifies its historical interests with the Yamassee people, their connections to Seminole history, and the historical laws, records, agreements, and governmental relationships affecting the Yamassee people.
These include the early South Carolina colonial enactments recorded in The Statutes at Large of South Carolina, including the 1707 legislation concerning the better regulation of the militia, to the extent that the enactment and its particular provisions are established by historical documentation and legally applicable to the rights asserted.
The Tribe expressly reserves the right to present, establish, defend, and pursue any historical, ancestral, property, cultural, governmental, contractual, or other rights recognized under applicable law.
The absence of federal acknowledgment shall not, by this notice, be treated as a voluntary abandonment, concession, or relinquishment by the Tribe of its asserted Indigenous identity, historical continuity, or otherwise legally cognizable rights.
Nothing in this notice represents that federal recognition has been granted, that a particular court has established the Tribe's sovereign immunity, or that the cited colonial enactments independently confer present-day federal recognition, civil jurisdiction, or immunity from suit.
3. Non-Waiver of Tribal and Proprietary Rights
To the fullest extent permitted by applicable law, the Yamassee Indian Tribe and Red Stick Communications & Media reserve their respective legal, equitable, contractual, intellectual-property, and other enforceable rights.
Nothing in this notice shall be construed as an express waiver, abandonment, relinquishment, or voluntary surrender of any sovereign immunity, governmental authority, legal claim, jurisdictional objection, defense, cultural interest, or proprietary right that the Tribe or the business may lawfully possess.
Any waiver of an applicable sovereign immunity or other legally waivable protection must satisfy the governing legal requirements and be authorized by the entity possessing that protection.
This provision does not create immunity, expand jurisdiction, displace applicable law, or bind a court to a particular determination of the Tribe's legal status.
4. Copyright Protection
Original authorship embodied in the platform may be protected under the United States Copyright Act, including 17 U.S.C. §§ 102 and 106.
Protected expression may include qualifying original software code, written lessons, stories, illustrations, graphics, animations, music, sound recordings, audiovisual presentations, educational publications, and other original creative materials.
Copyright protection extends to qualifying expression and not, solely by virtue of copyright, to underlying ideas, discoveries, educational methods, systems, procedures, concepts, or methods of operation, as provided under 17 U.S.C. § 102(b).
Except as permitted by applicable law, including fair use and other statutory exceptions, or authorized by the relevant rights holder, users may not reproduce, distribute, publicly display, publicly perform, or prepare infringing derivative works from protected platform content.
5. Trademarks, Branding and Commercial Identity
Red Stick Communications & Media asserts rights, to the extent established by applicable law, in the distinctive names and marks used to identify its educational products and services, including:
- Hadjo Tribal Education™
- Hadjo Education™
- Hadjo Education System™
The names, identifying logos, distinctive characters, slogans, and other brand elements may receive trademark, service-mark, copyright, or other protection where the applicable legal requirements are satisfied.
Unauthorized use likely to cause confusion concerning the origin, sponsorship, endorsement, affiliation, or approval of products or services may violate applicable law, including 15 U.S.C. § 1125(a).
The use of ™ signifies a claim of trademark rights and does not indicate federal registration. No representation of federal registration is made unless and until registration is obtained.
6. Independent Contributors and Third-Party Rights
The platform recognizes and respects the separately owned intellectual-property rights of independent authors, illustrators, educators, artists, developers, and other contributors.
In particular, books, illustrations, characters, manuscripts, and other original works owned by Sheryl McFarland remain her intellectual property unless particular rights have been assigned or licensed through a valid written agreement.
Their inclusion in or association with the platform does not, by itself, transfer copyright ownership to Red Stick Communications & Media or the Yamassee Indian Tribe.
The use, reproduction, adaptation, promotion, and distribution of contributor-owned content shall be governed by applicable written licenses, permissions, or ownership agreements.
Third-party software, open-source components, AI-assisted materials, and licensed resources remain subject to their applicable ownership rights, license terms, and legal limitations.
7. Software Licensing and Restrictions
Access to the educational platform does not constitute a sale or assignment of its intellectual property.
Users receive only the limited permissions expressly provided in the applicable Terms of Service, subscription agreement, educational license, or other authorized agreement.
Except as permitted by applicable law or an applicable license, unauthorized copying, resale, redistribution, commercial exploitation, removal of rights notices, or creation of infringing derivative works from protected platform materials is prohibited.
No person may falsely represent ownership, sponsorship, endorsement, or authorization by Red Stick Communications & Media or the Yamassee Indian Tribe.
Access to confidential source code, proprietary technical documentation, nonpublic instructional resources, or protected business information does not authorize disclosure or use beyond applicable permissions.
8. Cultural Heritage and Indigenous Educational Materials
The educational platform is intended, in part, to support the preservation, teaching, transmission, and respectful presentation of Indigenous history, cultural knowledge, heritage, and educational traditions.
Red Stick Communications & Media and the Yamassee Indian Tribe reserve all rights and interests in original cultural and educational materials they lawfully own or control.
Nothing in this notice claims exclusive copyright ownership over historical facts, public-domain materials, traditional knowledge as such, or independently owned works of other Indigenous peoples, authors, or communities.
The use of original tribal publications, distinctive educational works, identifying marks, and nonpublic materials remains subject to applicable law, lawful ownership, and agreed restrictions.
9. Enforcement and Reservation of Remedies
Red Stick Communications & Media and any other lawful rights holder reserve the right to pursue available legal and equitable remedies for infringement, misappropriation of protected trade secrets, breach of contract, deceptive commercial practices, trademark infringement, unauthorized exploitation, and other legally actionable conduct.
Available remedies may include injunctive relief, monetary relief, takedown procedures, and other remedies authorized by applicable law.
This notice does not restrict lawful fair use, independent creation, permitted reverse engineering, statutory exceptions, or other rights protected by law.
10. No Implied Transfer, License or Waiver
Nothing contained in this notice, or in the mere availability of the platform to the public, conveys ownership or an unrestricted license in protected intellectual property.
No waiver of any applicable right or remedy shall be inferred solely from a failure or delay in enforcing that right.
Any transfer of copyright ownership must satisfy applicable law, including the written-transfer requirements of 17 U.S.C. § 204 where applicable.
© 2026 Red Stick Communications & Media. All rights reserved in original platform materials owned by the company.
An educational enterprise associated with the Yamassee Indian Tribe of Seminoles / Yamassee Nation.
This notice identifies asserted rights and applicable legal reservations. It does not itself establish ownership, federal tribal acknowledgment, sovereign immunity, or statutory protections that require separate legal proof.
Learning samples
